Terms and Conditions for Upton Growth, LLC Short Term Rental Website

Acceptance of Terms

By accessing or using the Upton Growth, LLC (Upton Growth) website and booking a short-term rental, you agree to be bound by these Terms and Conditions, including the cancellation and refund policy outlined below. If you do not agree to these terms, please do not use the website or book a rental.

Website Use

User Conduct: You agree to use the website for lawful purposes only and in compliance with all applicable laws and regulations. You shall not: (a) engage in any unlawful or prohibited activity; (b) transmit any harmful or malicious code; (c) interfere with or disrupt the website or its servers; or (d) attempt to gain unauthorized access to any part of the website or its systems.

Accuracy of Information: While Upton Growth strives to provide accurate and up-to-date information on the website, it does not guarantee the accuracy, completeness, or reliability of any content.

Booking and Payment

Booking Confirmation: Upon successful completion of the booking process, you will receive a booking confirmation email. This email will contain the details of your reservation, including the property address, check-in/check-out times, and total cost.

Payment: Payment for your rental is required in full at the time of booking. Upton Growth accepts all major credit cards.

Taxes and Fees: All applicable taxes and fees are included in the total price of the rental.

Cancellation and Refund Policy

Cancellation by Guest:

  • Full Refund:Guests may cancel their reservation up to 30 days before the check-in date to receive a full refund.
  • Partial Refund:Cancellations made between 14 to 29 days before the check-in date will receive a 50% refund of the total booking amount.
  • No Refund:Cancellations made less than 14 days before the check-in date will not be eligible for a refund.

Cancellation by Upton Growth:

  • In the unlikely event that Upton Growth needs to cancel a reservation, guests will receive a full refund of the booking amount.

Early Departure:

  • No refunds will be issued for early departures or unused nights.

Refund Process:

  • Refunds will be processed within 7-10 business days from the date of cancellation. The refund will be issued to the original payment method used at the time of booking.

Force Majeure:

  • Upton Growth is not liable for any refunds or compensation in the event of force majeure, including but not limited to natural disasters, acts of terrorism, or government regulations that prevent the guest from traveling or staying at the property.

Property Rules and Guest Conduct

    Property Rules: Each property has specific house rules that guests must adhere to. These rules are provided below and can also be found on the property premises.

    • Overnight Guests: To ensure a comfortable stay for all guests, overnight visitors exceeding the maximum occupancy stated in the listing are strictly prohibited unless prior approval has been granted.
    • Smoking: Smoking is strictly prohibited indoors. For those who smoke, please use the designated ashtray in the backyard and dispose of ashes and remnants responsibly.
    • Parties: Hosting parties is not permitted. However, small family gatherings related to military events or ceremonies may be allowed with prior approval.
    • Noise: To maintain a peaceful environment for all, please keep noise levels to a minimum between 10:00 PM and 6:00 AM.
    • Outdoor Cameras: Guests are prohibited from interfering with the outdoor surveillance cameras in any way, including tampering or repositioning.
    • Furniture: To preserve the property’s aesthetic, please refrain from rearranging the furniture.
    • Pets: Pets are not allowed on the property.

    Guest Conduct: You agree to respect the property and its surroundings. Any damage caused by you or your guests may result in additional charges.

    Occupancy: The number of guests allowed at the property is limited. Overoccupancy is not permitted and may result in eviction without refund.

    Please note: These rules are in place to ensure a pleasant stay for all guests and to protect the property. Failure to comply with these rules may result in additional penalties or termination of your stay.

    Penalties

    • No-Smoking Violation: A minimum fee of $250 will be charged for any violation of the no-smoking policy.
    • House Rule Breaches: Any violation of the house rules may result in additional charges. These charges may include the cost of replacing damaged furnishings, additional cleaning fees, or waste disposal fees.
    • Surveillance Camera Interference: Any interference with the outdoor surveillance cameras will result in immediate eviction from the property without refund.

    Modifications to Reservation

    Check-In and Check-Out Times

    Upton Growth strives to accommodate guest requests for modifications to check-in and/or check-out times. However, please note that these requests are subject to availability and may incur additional fees. Guests must submit modification requests at least 7 days prior to their original check-in date. Upton Growth will make reasonable efforts to confirm the requested modifications and notify the guest accordingly.

    Modification Fees

    If a modification to the reservation is approved and results in a change to the total rental cost, the guest will be responsible for paying any additional fees or receiving a refund as applicable.

    No Guarantee of Modifications

    Upton Growth cannot guarantee that all modification requests will be granted. Factors such as property availability, cleaning schedules, and other operational considerations may impact the ability to accommodate changes.

    Liability

    Disclaimer of Warranties: Upton Growth makes no representations or warranties of any kind, express or implied, about the website or the properties listed on the website.

    Limitation of Liability: Upton Growth shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the website or the rental of a property.

    Indemnification

    You agree to indemnify and hold harmless Upton Growth, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including attorneys’ fees) arising out of or in connection with your use of the website or your violation of these Terms and Conditions.

    Governing Law

    These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Oklahoma. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved exclusively in the state and federal courts located in Lawton, OK.

    Changes to Terms and Conditions

    Upton Growth reserves the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of the website after any changes indicates your acceptance of the revised Terms and Conditions.
